the applicant has admitted or has not disagreed that at least two locations, 301 sacramento street and 303 south sacramento street did not receive notice of the permit. and they sort of tried to distinguish between the notice of the permit and the notice of an appeal and i think those are two very separate issues. the public works code says that businesses within a 300' radius are entitled to receive notice of the permit. what is the use of giving a notice of appeal after everything is said and done? the second issue is i believe due to radius services mistake, the whole block was missed floatfication area and that is because radio services calculates notice the block using the assessor's block as opposed to what is stated in the public works code, which is the mid-point of the block face. can i just go to this overhead real quickly? okay. so where the x is where expresso subito did the 300' radius, but where the little star is the actual block face. so all the businesses down here were not notified and one business that dpw testified to was 101 2nd street and no one from that buil

301 sacramento and 303 sacramento wrong. it's bigger than that. radio services just extrude up royally. and i'm going back to my map. radius services determined the midpoint of the assessor's block when the law is the midpoint of the block face. and within the public works code, it distinguishes between a block face and an assessor's block. "assessor's block" is perhaps could be three-block faces as in this case. and it's used multiple times in the public works code. amid the block face where the star is. and all of these businesses did not receive notice. so dpw testified a couple of months ago that 101 2nd street is within a 300' radius. i want to ask dpw did anyone at 101 2nd street receive notice? if they did not, notice was not served properly. the second point is the 300' radius. the ordinance use the word "radius." the order itself says there are no like foods within a 300' radius. radius is the proper measurement and dpw is going to get up here and say oh, no, we're going use walking distance and we can't determine what a 300' radius, when they are required to send out

violence in san francisco last night. police in sacramento are investigating a deadly shooting near a fireworks show. our reporter mike lori tells us two people were killed three others were hurt. what happened out there, mike? >> reporter: well, dave, sacramento police say they have the shooter in custody. the 22-year-old gunman is in the hospital right now. he too was shot it turns out by an armed sure guard who intervened and actually stopped the deadly shooting before it claims even more lives. we do know that two people are dead and three injured following a shooting this tack place a at a bar in old sacramento. one of those dead is an employee, believed to be a waiter who worked in the restaurant. the incident forced the cancellation of new year's eve celebrations, causing thousands of people to head for home without any fireworks at all. here's what one eyewitness told us about. >> we heard gunshots. the dude came into that hooka place shooting. come back out. ran around the corner and was firing down the sidewalk. some guy with a baby in a stroller, i watched him pick up str

. towards the port of sacramento and briefly ran aground in the sacramento river deep water ship channel. two days later, on august 29, 2009, kleess was piloting a ship on the san joaquin river to stockton. while docking the ship, it collided with a wooden pylon, damaging a cat walk. for these two instances, klees was ordered to take practice trips with an experienced pilot. and on may 26th of 20-10, kleess was supervising a trainee on a ship. the ship was tied to a tugboat en route to the richmond inner harbor. the tugboat made contact with the bottom of the channel. causing minor damage. pilot error was found, but no action was recommended the director of the board of pilot commissioners say, new regulations are in the works to regulate bar pilots. >> this will increase toxicology and increased the agility with physical ability and create a medical review regimen. these regulations grew out of the cosco bucson incident. the director is hopeful regulations will be enacted this year. >> the cosco busan tanker crashed into the bay bridge five years ago. spilling more than 50- thousand gal
